Cybersecurity solutions are provided including, but not limited to, vulnerability assessments, penetration testing, system and network monitoring, and security training. The specific services to be provided will be detailed in the Service Level Agreement (SLA).
The Client must provide accurate and timely information, access to necessary systems, and support as required to enable effective service delivery.
Binary IT pledge utmost discretion with all client data. Any data accessed during the services will be treated as confidential and is bound to strict confidentiality agreements.
While we, Binary IT, aim for comprehensive security, no service can guarantee complete protection against all potential threats. We commit to industry-leading practices to safeguard your assets.
All software, processes, methodologies, and tools used during the service remain the proprietary property of Binary IT unless otherwise agreed.
Neither party will be liable for any delay or failure to meet their obligations due to circumstances beyond their reasonable control, including natural disasters, terrorism, strikes, or power outages.
All service fees will be as per the signed agreement. Late payment may result in suspension of services or additional charges.
Any client data retained during or after the service provision will be stored securely, with encryption as standard, and will not be kept longer than necessary.
In some cases, Binary IT may incorporate third-party solutions. We ensure all third-party providers adhere to rigorous security standards, but any third-party involvement will be transparent to the client.
Should any vulnerabilities or security breaches be discovered during the service, Binary commits to immediate disclosure, along with guidance on remedial measures.
The client agrees to indemnify and hold harmless our company, its affiliates, and its personnel against any losses, liabilities, and claims arising out of the client’s failure to adhere to these terms or any provided recommendations.
Any disputes arising out of these terms shall first be addressed through mediation or arbitration before seeking a resolution in court.
Either party may terminate the agreement with 30 days written notice. Specific termination terms and consequences will be detailed in the SLA.
Binary IT’s total liability, for any damages arising from the services, shall be limited to the total fees paid by the client. We shall not be liable for any indirect or consequential losses.
These terms may be amended or updated from time to time, with prior notice to the client, especially to adapt to technological advancements or changes in laws.
Engaging our services indicates acceptance of these terms and conditions. Clients are advised to read and understand all terms before engagement.
